Liverpool Daily Post

ANOTHER man was arrested yesterday over a brawl in Southport for which Liverpool FC captain Steven Gerrard is appearing in court later this month.

The 19-year-old from Huyton was brought in by police yesterday afternoon on suspicion of assault and affray, after the incident at the Lounge Inn on December 29. Police last night released him on bail, pending further inquiries.

Gerrard, 28, of Formby, is charged with assault occasioning actual bodily harm and affray, along with John Doran, 29, and Ian Smith, 19, both from Huyton.

The three were among a group of six held at Southport police station for close to 24 hours.

The fracas allegedly broke out over a song choice and left local businessman and part-time DJ Marcus McGee with facial injuries.

I bet CPS direct is based in Manchester.

I tghink you will find its been like that for 22 years.

Well as I have never been arrested for ABH I wouldn't know, However I have been consulting with a friend who works at the CJD (criminal justice department) and they have informed me that the original bail to appear in court would be police bail and between the time he is bailed by the police and appears in court is when the CPS look at the case and decide if their is a case to answer and put together their case against him (if there is one). He may have been charged by the police but when he appears in court the CPS may decide there is no case to answer and offer no evidence.
Don't shoot the messenger it is just what I have been told by my mate.

That is right, but the CPS will NEVER reccomend a charge unless they are 90% certain of gettig a conviction.

There are just too many targets and financial constraints.

If it goes to a jury trial then there's no possiblity of knowing how certain anyone can be of a prosecution. I've done jury service twice in the last five years, the last case I sat on we had little choice but to find not guilty because the physical evidence was inadmissable and it was accuser's word against accused's and the only other witness was unreliable - the accuser's daughter being one of the things that made her unreliable.

Still made it to court, wasted a few days of taxpayer's money. Not sure that 90% claim has any foundation. I've been on a trial or two where there was a delay and last minute negotiating between lawyers meant the case never went through. I'm sure if Gerrard quotes a figure or two then the alleged victim will let it go.

Im sure the guy just wants a bit of cash. Anyway how do we prove how much damage Gerrard has did and how much was done by others. If Gerrard decked him, walked away and his mates did the rest then he's no longer part of a joint enterprise so who do you charge with what?

A PROFESSIONAL footballer was being questioned today over the alleged bar brawl that has seen Liverpool skipper Steven Gerrard face criminal charges.

Accrington Stanley reserve goalkeeper Ian Dunbavin, 28, was arrested at his Southport home just after 8am today.

He was taken to his local police station where he was set to be quizzed throughout the day on suspicion of assault and affray.

The former LFC youth team player was out with Gerrard in the early hours of December 29. They were part of a group in the Lounge Inn, on Bold Street, Southport, when a fight broke out at around 2.30am.

Local businessman and dad-of-two Marcus McGee was left with bruises and a missing tooth after being punched in the face.

The fight was sparked when a song request made by the Gerrard group was turned down.

Six men, including Gerrard, were arrested nearby and the England midfielder spent 20 hours in police custody before he was charged with assault occasioning actual bodily harm and affray.

He will appear at Southport magistrates’ court next Friday alongside John Doran, 29, of Woodlands Road, Huyton, and Ian Gerard Smith, 19, of Hilary Avenue, Huyton, who face the same charges.

Dunbavin started his career at Liverpool’s academy and was an unused substitute in the 1996 FA Youth Cup final. After being let go by the Reds, he went on to join Shrewsbury Town, York City and Halifax Town before signing for Stanley in July 2006.

He was first choice keeper for much of his first season but suffered a nasty injury and lost his place. He has yet to make a first team league appearance this season.

Dunbavin, originally from Huyton, is the second Stanley player to be arrested in connection with the brawl.

Winger Bobby Grant, 18, of Litherland, was one of those originally arrested and questioned but he was released on bail pending further inquiries.

just see a good bit on the news about this case, it seems there are two ways this case look like going.
they are saying that the case for Gerrard could be thrown out due to lack of evidence that he himself did any thing.
and the other way is that Gerrard will have to pay the cost of his case and a sum of money to the guy and 150 hours community service.

Gerrard has submitted 40 character witness   :D
