The owner of a hair salon has been ordered to pay £4,000 compensation to a Muslim stylist who was turned down for a job because she wears a headscarf.

Bushra Noah accused Sarah Desrosiers of religious discrimination when she failed to offer her a job at her Wedge salon in King's Cross, central London.

An employment tribunal panel dismissed the 19-year-old's claim but upheld her complaint of indirect discrimination.

Ms Desrosiers said she needed stylists to showcase alternative hairstyles.

During the hearing Ms Noah, who lives in Acton, west London, told the tribunal that she was "devastated" that she was not offered the job of assistant stylist "due to my headscarf".

Ms Desrosiers, 32, told the panel that Ms Noah lived too far away, but was persuaded to give her an interview in May last year.

When the applicant arrived for the interview she claimed the Canadian salon owner was clearly shocked by the fact she wore a headscarf.

Sarah Desrosiers

Ms Desrosiers told the tribunal she was surprised it had not been mentioned earlier and expected her staff to reflect the "funky, urban" image of her salon.

The panel found that Ms Noah had been badly upset by the 15-minute interview .

She was awarded £4,000 damages for "injury to feelings".

In its judgment, the panel stated: "We were satisfied by the respondent's evidence that the claimant was not treated less favourably than the respondent would have treated a woman who, whether Muslim or not, for a reason other than religious belief wears a hair covering at all times when at work."

It added: "There was no specific evidence before us as to what would (for sure) have been the actual impact of the claimant working in her salon with her head covered at all times."

Speaking after the ruling the salon owner said: "I never in a million years dreamt that somebody would be completely against the display of hair and be in this industry. I don't feel I deserve it."

Ms Noah refused to comment on the matter.


what is this country coming to? will we done for racism every time someone of a difference race or colour doesnt get something there own way? even when, like here, it is absolutely ludicrous???

who was on that panal and what in gods name do they think they were doing making this person pay 4 grand for someone not getting a job she was offering f*cking jobs worth tw@ts

just makes me want to slap them silly and ask them what the f*ck they are playing at  :veryangry  :veryangry

That was like that woman who got finished as being a proimary school teacher because she wore a burkha. The kids were all sh!tting themselves by all accounts. The thing was in her particular case, when she turned up for the interview she didn't wear it, but then once she'd got the job she insisted it was her cultural right and all that stuff.

One of the biggest shames about such things which just about never gets commented on, is that I think such cases are a real body blow to the cause of truly integrating different cultures. The vast majority of people just want to go to work, earn some cash, have some kids, watch some telly, have a sh@g from time to time and then take up gardening and getting up at five in the morning in their old age. This applies whether they are muslim people, jewish people, protestant people, catholics and of course the vast majority of people in the Uk who are not really any religion at all thanks very much except for funerals and weddings type of people. 

Why can't all cultures just distance themselves from these nutters which invade every crevice of our society? If somebody wants to be a muslim person, lovely get on with it mate. Similarly if they want to be Mormons or whatever else. Just so long as whatever they believe in doesn't involve me or my family getting blown up by some nutter, or me having to get a side parting and using the word "shoot" where I would normally say "sh!t" I'm all for it. These pathetic planks who sit on these panels should kick such cases out of court and charge the feckers who bring them before the authorities all the costs.

Everyone has a right to their religion Mick or equally a right not to practice any as you say
Your post reminded me of a discussion on a radio phone in lately.
A Sheikh policeman (somewhere in England) has caused a whole big contraversial storm because he is refusing to take his turbin off when he is expected to wear a helmet.For example in riot situations or drugs busts!
He says it is an infringement of his religious rights to make him remove it! :D
Obviously for his own safety they are insisting he follows normal sensible procedure and wears the right head gear but hes having none of it.I dont know if the situation has been resolved yet but it just made me laugh.I sometimes think these people are so dedicated and devout that it actually stops their perceptions of common sense!

Personally if i was his boss id teach him a lesson.Next drugs bust id put him at the front of the line in his turbin,yes!
First through the door old sheikh lad!
Then when a junkie jumps out and smacks him round the head with a cricket bat it may teach him a lesson in common sense.Next drugs bust id bet he would be the first to put his helmet on.

Our country is that soft though he'd probably get a claim for his injuries though! :D

alternatively it could be the perfect opportunity for a big push forward in turban safety technologies. kevlar turbans, for example, just to get started. there's money in it, i tell ya.

i think i read about that police bloke and that they were going to have a helmet made just for him ( or anyone else that has a turban ) at a cost of £1000 a go
