Stevies trial - found not guilty of affray

Liverpool Football Club - General Discussion

Postby NANNY RED » Mon Jul 20, 2009 11:03 am

Liverpool captain Steven Gerrard has arrived at court to stand trial in connection with a fight at a Merseyside nightclub last year.

The 29-year-old is due before Liverpool Crown Court with six others and denies a charge of affray relating to the incident at Southport's Lounge Inn.

A 34-year-old businessman was injured at the bar on 29 December.

Mr Gerrard, from Formby, Merseyside, had been celebrating Liverpool's 5-1 win over Newcastle United.

The other defendants include Accrington Stanley goalkeeper Ian Dunbavin, 28, of Guildford Road, Southport and Accrington midfielder Robert Grant, 18, of Enstone Avenue, Litherland.

Four men from Huyton, Merseyside, are also charged. They are: John McGrattan, 33, of Rimmer Avenue; Paul McGrattan, 31, of Linden Drive; John Doran, 29, of Woodlands Road; Ian Smith, 19, of Hilary Avenue.

The trial is expected to last two weeks.

CCTV will be used to show him being involved, it is said that it shows him trying to punch someone but the punch no hitting anyone. Another cctv shows him with a upside down bottle in his hands falling over by the DJ stand.

Affray in English Law

A person is guilty of affray if he uses or threatens unlawful violence towards another and the person's conduct is such as would cause a person of reasonable firmness present at the scene to fear for his personal safety.
Where two or more persons use or threaten the unlawful violence, it is the conduct of them taken together that must be considered for the purpose of subsection .

Ramifications

Three years imprisonment and/or a fine on indictment; six months imprisonment and/or a fine summarily

The Manc b*stard as you so elequantly put it :D  dropped the charges soon after the event. Its the CPS that are persuing it.  One good thing to come out of it is he won't get injured in some nonsence pre season friendly against some over enthusiastic tiddly wink.

He will most likely get a heavy fine and be bound over for 12 months.

if you tried to knife someone but only cut their lip it would not matter that it was only a cut lip, its said he tried to use a bottle  and a fist. if he is found to have done it he will have a problem.

its 2 weeks due to the court needing to look at all of the others aswell, he might only be there for 1 to 2 days then go back to hear the result.

hmm don't like the bit about Stevie holding an upside down bottle, or was he just indicating he needed a refill.  :wwww

I agree that this is a nonsense case though, I can't believe people have so little honour and self respect that they can't take this kind of thing on the chin, no pun intended, without going to the pigs. I mean it is fairly clear that this fella who got a smack must have been winding Stevie up, pr1cks like that get a much deserved smack up and down the country every weekend, as long as it's no more than that what's the problem.

It's like Saturday night when I had to turn into a bodyguard to prevent my mate getting his :censored: kicked on a few occasions, nothing serious, he was just in a very good mood and hitting on every girl in the nightclub, even those who obviously had boyfriends with them, not generally a good idea in viking territory! Having said that if he did get a smack it would probably have been deserved.
