Affray in English Law

A person is guilty of affray if he uses or threatens unlawful violence towards another and the person's conduct is such as would cause a person of reasonable firmness present at the scene to fear for his personal safety.
Where two or more persons use or threaten the unlawful violence, it is the conduct of them taken together that must be considered for the purpose of subsection .

Ramifications

Three years imprisonment and/or a fine on indictment; six months imprisonment and/or a fine summarily

Love to know where 5live get there info from Lakes,  How the h.ell would anyone know whats on that cctv unless there working on the case, It should never have got his far, should have been dealt with in the Maj, its just some jumped up prosecution trying to make a name for themselves, with a bit of luck it, it will get kicked out after a few days, then he can be left to concentrate on getting fit, its a fecking joke,

its for me to know and you to find out lol.

in truth the newsrooms are full of it right now, the defendant must know the evidence before them, they are not aloud to use surprise evidence.

the press are over this so its no shock to find out what they have on him.

the first thing that has to come up is if the court will see the CCTV, just reading on another forum that its still a gray area in this case.

i was sure that it was going to be used.

They'll be cleared of all charges i'm sure.

I had my head stoved in by 3 lads a couple of years back and had my jaw broken as they played football with my head. They had no clear CCTV showing who of the 3 kicked me in the head so had to have all charges dropped as any 1 of them could have caused the injury!!!

Will be the same here and having also spoken to a mate who is a solicitor about this over a pint or 10 a while back he said they won't be able to even convict for Affray as would need sound to prove what was said. Unless CCTV clearly shows Steve grabbing & threatening him it'll be a not guilty verdict & the same for all the others!!!!
Shankly on boardroom meetings - 'At a football club, there's a holy trinity - the players, the manager and the supporters. Directors don't come into it. They are only there to sign the cheques.'

well if it shows him trying to punch him then he will get done for something, It dont matter that he did not hit him, dont think he was the one to cut his lip.

Obviously if Stevie is innocent we want him to be cleared..... however if he's guilty he's as answerable to the law as much as you or me.

If it was any other player we'd be saying different...

and its a 2 week trial including all men charged, not just Stevie

Wrong its a total mountain out of a molehill! The fella was barely even injured!
There are dozens of worse things happen in bars in every city in the country every weekend.

Its been made into a whole big show BECAUSE a footballer is involved! Two week trial for something that happens hundreds of times every friday and saturday night, its an absolute joke...Im not saying that a glassing(if it happened)should be condoned but there are poor feckers kicked half to death and the culprits are in court two days later bound over to keep the peace, fined and its forgot about!

A total circus is what it is and a waste of taxpayers money!

It's a relatively minor, high volume offence so he's more than likely to get a community sentence. It's not unusual for these cases to last a few weeks, either, given the number of parties involved.

Just been on Sky news all other defendants ,6 in total, have pleaded guilty!

Presume Steven is still pleading not guilty.

hmm that sounds worrying, there must be enough evidence to convict then otherwise why plead guilty, unless they are pleading guilty for a minor charge.

i would take it that he has said the same as them, this would mean he would get less if he was found guilty after saying not guilty.

if he is found guilty after stating not guilty the outcome is a lot harder.
