No, downloading is not illegal. The site that JBG plugged www.the-underdogs.org , has no illegal downloadings within it, and encourages buying old titles.
It's time to remove the big lie "downloading is illegal". That's plainly wrong. "downloading copyrighted material IS illegal", not the titles that some companies have allowed free distribution.

This being Nintendo, everything is a bit secretive at the moment. We don't know a third of the info about the rev, but Iwata has said that "most" games will be free to download. Some will even have added bits and pieces like Mario 64 DS, but to be honest, no-one has a freaking clue. The whole thing is so shrowded in secrecy that most statements are just guess work and even the most talkative of Ninty execs are keeping their traps shut. Apparently there is still some amazing, big secret that hasn't been spilled yet.

Final Fight! Now thats a game I like, I bought the Capcom Arcade Classics game for PS2 and that was on it. Its like Streets of Rage but with better graphics
It's my fav RPG alongside Wizardry 8. I finished them all years ago, Eye of the Beholder I , II, and III with no cheating. Yo had to do your own maps. bloodwych was a similar title in the AMIGA and Atari ST, but slightly worse. The best of the saga was the EOB II, IMHO.
